1. About this policy

American Premium Vodka, LLC ("American Premium Vodka," "we," "us" or "our") is an Arizona limited liability company. We are responsible for the personal information described here.

This policy applies to americanpremiumvodka.com, our emails and texts, our social media pages, our events and promotions, and anywhere else that links to it (together, the "Site"). It also explains how we handle information you give us offline, for example at a tasting event.

It doesn't cover sites and services run by others, even when we link to them, such as retailers, 1-800 T-Shirts (our merchandise partner), the American Legion, VFW or Instagram. Their own privacy policies apply.

The Site is only for adults of legal drinking age, 21 or older. Using the Site also means you agree to our Terms and Conditions.

We don't sell your personal information for money. Where state law treats some advertising cookies as a "sale" or "sharing," Section 7 explains how to opt out.

2. Information we collect

We collect information you give us, information collected automatically when you use the Site, and information from partners.

What we don't collect

• Payment cards. We don't sell alcohol or merchandise on the Site, so we don't collect card details. Retailers and 1-800 T-Shirts handle payments under their own policies.
• Sensitive data. We don't ask for sensitive personal information, such as Social Security numbers, health data or precise geolocation. Please don't send it to us.

3. How we use your information

We use personal information to:

1. Run the Site. Show pages, remember your age-gate answer, keep the Site secure and fix problems.
2. Check age. Keep alcohol marketing away from people under 21, as the law and industry codes require.
3. Answer you. Reply to contact form messages, retail and distribution enquiries, press and partnership requests.
4. Help you find our vodka. Use the city or ZIP you enter to show nearby stores.
5. Send marketing you asked for. Newsletters, new drops, events and offers by email or text, only with your consent where the law requires it.
6. Run promotions and events. Check eligibility, pick and contact winners, deliver prizes and follow promotion laws.
7. Feature your content. Repost content you tagged us in, with your permission.
8. Understand and improve. Measure how the Site and our campaigns perform, and improve our products, Site and marketing.
9. Advertise. Show ads for American Premium Vodka to adults 21+ on other sites and social platforms (see Section 4).
10. Protect rights and safety. Prevent fraud and misuse, enforce our Terms, and protect our copyrights, trademarks and other intellectual property.
11. Follow the law. Meet legal, tax, record-keeping and regulatory duties, and respond to lawful requests.
12. Business changes. Evaluate or complete a merger, sale or reorganisation of our business.

We may combine information from different sources for these purposes. We may also create de-identified or aggregated data that no longer identifies you, and use it for any lawful purpose. We won't try to re-identify it.

Legal bases (visitors outside the U.S.)

Where laws such as the EU or UK GDPR apply, we rely on your consent (marketing, non-essential cookies), our contract with you (promotions you enter), our legitimate interests (running, securing and improving the Site, and brand protection), and legal obligations.

4. Cookies, analytics and advertising

Cookies are small files stored on your device. Pixels, tags and similar tools do the same job. We and our partners use them as follows.

Your choices

• Non-essential cookies. We don't use advertising cookies today. If we add any non-essential cookies, we'll show a cookie banner so you can choose, and add a Cookie settings link to the footer.
• Browser controls. Most browsers let you block or delete cookies. Blocking essential cookies means the age gate asks you every visit.
• Global Privacy Control. We treat a Global Privacy Control (GPC) signal from your browser as a request to opt out of the sale or sharing of your information for targeted advertising, for that browser.
• Do Not Track. There's no common standard for Do Not Track signals, so we don't respond to them. We do honour GPC.
• Ad industry opt-outs. You can opt out of interest-based ads from many companies at optout.aboutads.info and optout.networkadvertising.org.

Responsible advertising

We ask our advertising partners to show our ads only to audiences where at least 73.8% are expected to be of legal drinking age, in line with the Distilled Spirits Council Code of Responsible Practices.

5. How we share information

We share personal information only as described here.

• Service providers. Companies that work for us under contract: website hosting, email and text platforms, analytics, customer service tools, store locator and map providers, promotion administrators and IT security. They may use the information only to provide their services to us.
• Advertising and social partners. Ad networks and social platforms receive device and usage data through cookies and pixels to measure and show our ads (see Section 4). You can opt out.
• Retailers and distributors. If you ask about stocking our vodka, or ask us to put you in touch with a store, we may pass your enquiry to the relevant retailer or distributor.
• Our merchandise partner. If you contact us about a merch order, we may pass your message to 1-800 T-Shirts so it can help you. Orders you place with them are covered by their privacy policy.
• Promotion partners. If a promotion is run with a partner, the official rules will say what we share with them.
• Public content. Content you post publicly, or that we repost with your permission, can be seen by anyone.
• Legal and safety. When we believe the law requires it, or to respond to lawful requests from authorities, enforce our Terms, protect our intellectual property, or protect the rights, property or safety of anyone.
• Business transfers. As part of a merger, acquisition, financing, or sale of all or part of our business. The new owner will be bound by this policy for information collected under it.
• With your consent. Anywhere else you've agreed to.

No sale for money

We don't sell personal information for money, and we don't knowingly sell or share information about anyone under 21. Some state laws treat advertising cookies as a "sale" or "sharing" of personal information. If so, you can opt out as Section 7 explains.

6. Emails, texts and your marketing choices

• Email. We send marketing emails only to people who sign up and confirm they're 21 or older. Every email has an unsubscribe link. Opting out can take up to 10 business days. We'll still send messages you need, such as replies to your enquiry or prize notices.
• Texts. We send marketing texts only with your prior express written consent. Consent isn't a condition of any purchase. Reply STOP to opt out and HELP for help. Message frequency varies, and message and data rates may apply. We don't share mobile numbers or text consent with third parties for their own marketing.
• Social media. To stop seeing our posts, unfollow us. To change how platforms use your data for ads, use each platform's ad settings.
• Interest-based ads. See the choices in Section 4.

7. Your privacy rights

Depending on where you live, you may have the right to:

• Know and access the personal information we hold about you, and how we use and share it.
• Correct inaccurate information.
• Delete information we collected from or about you.
• Get a copy in a portable, machine-readable format.
• Opt out of the sale or sharing of your information, of targeted advertising, and of profiling that has legal or similarly significant effects.
• Limit use of sensitive personal information (we don't collect it).
• Appeal if we turn down your request.
• Not be discriminated against for using any of these rights.

We offer these rights to all U.S. visitors where we reasonably can. Some rights have legal exceptions, for example when we must keep records by law.

We'll confirm your identity before acting, usually by matching your email address and details you've given us. An authorised agent may make a request for you with your signed permission; we may still ask you to confirm your identity. We'll respond within 45 days, or tell you if we need up to 45 more days and why.

Appeals

If we deny your request, reply to our decision or email admin@americanpremiumvodka.com with "Appeal" in the subject within 60 days. We'll answer within the time your state's law allows, usually 45 or 60 days. If you're unhappy with the outcome, you can contact your state attorney general.

State-specific notes

• California (CCPA as amended by the CPRA). The categories in Section 2 are the categories collected in the last 12 months. We disclosed identifiers, internet activity and inferences to service providers and advertising partners for the purposes in Section 3. We don't use or disclose sensitive personal information to infer characteristics. Under California's "Shine the Light" law (Civil Code § 1798.83), you may ask once a year about disclosures for others' direct marketing; we don't make them.
• Other states with comprehensive privacy laws. Residents of states such as Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah and Virginia have the rights above, as their laws provide.
• Nevada. You may ask us not to sell covered information. We don't sell it, but you can still send that request to admin@americanpremiumvodka.com.

Visitors outside the United States

If laws such as the EU or UK GDPR apply to you, you also have the right to object to processing, restrict it, withdraw consent at any time, and complain to your local data protection authority.

8. Retention, security, minors and international visitors

How long we keep it

We keep personal information only as long as we need it for the purposes in Section 3, or as the law requires.

When we no longer need information, we delete it or make it de-identified.

Security

We use reasonable administrative, technical and physical safeguards, such as encrypted connections (HTTPS), access controls and vetted service providers. No system is completely secure, so we can't guarantee security. If we learn of a breach affecting your information, we'll notify you as the law requires.

People under 21

The Site is not for anyone under the legal drinking age. We don't knowingly collect personal information from anyone under 21, and the Site isn't directed to children under 13 under the Children's Online Privacy Protection Act (COPPA). If we learn we've collected information from someone under 21, we'll delete it. If you think a minor has given us information, email admin@americanpremiumvodka.com.

International visitors

We're based in the United States, and the Site is meant for U.S. visitors. If you visit from elsewhere, your information is processed in the United States, where privacy laws may differ from your own. Where the law requires, we use appropriate safeguards, such as standard contractual clauses, for international transfers.

Changes to this policy

We may update this policy from time to time. We'll change the "Last updated" date above. For material changes, we'll give notice on the Site or by email, and ask for your consent where the law requires.
